for Using zan Application

Introduction:

By using the zan application, you agree to comply with and be bound by the following Terms and Conditions, which govern the relationship between you and zan with respect to your use of the application. The purpose of these Terms and Conditions is to define ownership and responsibilities between the consumer (customer) and Al-Majal Al-Awhad LLC (Service Provider / zan Application) in relation to the use of the application and its policies, as outlined below.

1. Definitions:

The following terms and expressions shall have the meanings assigned to them below:

• Service Provider: Al-Majal Al-Awhad LLC, a limited liability company registered in the Kingdom of Saudi Arabia under Commercial Registration No. (7051104631), hereinafter referred to as "zan Application" or "zan".
• Customers: Any individual who wishes to benefit from the products and services provided by the Service Provider.
• Service: The provision of zan services through the application and delivery to the customer.
• Delivery: The delivery of goods ordered by the customer through the application.
• Merchant / Merchants: The supplier of goods to the customer via the zan application.
• Order: An order placed through the zan application.
• Products / Goods: Products or goods displayed and offered through the application by merchants.

2. Overview:

zan is a cloud-based platform that displays various products and goods offered by merchants. Customers place orders through the application, and the orders are delivered to them via zan's delivery team. All operations are managed by the Service Provider in accordance with its internal policies. These Terms and Conditions are governed by and interpreted in accordance with the laws of the Kingdom of Saudi Arabia.

3. Registration Data and Account Security:

By registering on the application, the customer agrees to:

• Provide accurate, complete, and up-to-date information.
• Maintain the confidentiality of their username and password.
• Accept all risks arising from unauthorized access to their account.

The customer acknowledges that they are solely responsible for maintaining the confidentiality of their account credentials. zan shall not be liable for any loss resulting from misuse of the account or password by the customer or any third party. The customer must immediately notify zan of any unauthorized use of their account.

4. Use of Personal Data:

zan collects personal data only when the customer uses the application's services. Such data includes:

• Name
• Email address
• Mobile number
• Delivery address

This data is collected for the following purposes:

• Communicating with customers
• Account registration and verification
• Sending promotional offers
• Improving delivery operations
• Enhancing user experience

zan is committed to protecting customer privacy and will not share personal data with third parties except as necessary to operate and improve the service.

5. Application Workflow:

• Merchants' products are displayed on the application.
• Customers place orders through the application.
• Customers confirm orders and complete payment.
• Orders are delivered to the customer's specified address.

6. Payment Methods and Procedures:

Orders are processed only after payment is completed. During payment, customers may be required to provide payment-related information.

Note:

• zan may use third-party payment service providers. Additional fees may be charged by zan or third parties, for which zan bears no responsibility.
• The customer authorizes zan to store and update payment information through the payment service provider when necessary.
• All prices include Value Added Tax (VAT) in accordance with Saudi regulations.

7. Return and Refund Policy:

No returns or exchanges are accepted, except in the following cases:

• Defective product
• Incorrect product delivered
• Product unfit for use

Compensation will be issued after verification by the zan team.

8. Control of Application Use:

zan reserves the absolute right to suspend or terminate any user's access to the application without providing reasons.

9. Amendments:

zan reserves the right to modify the application or these Terms and Conditions at any time. Continued use of the application constitutes acceptance of any amendments.

10. Indemnification:

The customer agrees to indemnify zan against any claims, losses, or damages arising from violation of these Terms and Conditions.

11. Notices and Communications:

Official communications will be sent to the email address registered by the customer and shall be deemed received upon sending. For communication with zan:

12. Intellectual Property Rights:

All intellectual property rights, trademarks, logos, and content related to the zan application are the exclusive property of zan and may not be used without prior written consent.

13. Limitation of Liability:

Services are provided "as is" without warranties. zan shall not be liable for any direct or indirect damages arising from use of the application.

14. Severability:

If any provision of these Terms is held invalid, the remaining provisions shall remain in full force and effect.

15. Assignment:

zan reserves the right to assign or transfer its rights and obligations to any third party.

16. Governing Law and Jurisdiction:

These Terms and Conditions are governed by the laws of the Kingdom of Saudi Arabia. The competent courts in Al-Khobar City shall have jurisdiction.
